Terms and Conditions of Sale
1. Introduction
1.1 Welcome to Spa Solutions Store Sauna Dekor. These Terms and Conditions apply to all sales of products by us to consumers, including online sales. By placing an order, you agree to be bound by these Terms and Conditions.
1.2 We reserve the right to amend these Terms and Conditions from time to time. Any changes will be effective from the date they are posted on our website.

3. Orders and Contract Formation
3.1 When you place an order, you are making an offer to purchase products subject to these Terms and Conditions.
3.2 After receiving your order, we will send you an email confirming receipt. This email will include details of your order, but it does not constitute acceptance of your order.
3.3 A contract between us is formed when we send you an email confirming that the products have been dispatched.
3.4 If we are unable to fulfill your order, we will notify you and provide a refund if applicable.
4. Delivery
4.1 Delivery will be made to the address provided by you at the time of order. It is your responsibility to ensure the delivery address is correct.
4.2 Delivery times are estimates and are not guaranteed. We are not liable for delays caused by circumstances beyond our control.
4.3 If we are unable to deliver within the estimated time frame, we will notify you and provide options including a new delivery date or cancellation of your order.
4.4 Risk of loss or damage to the products passes to you upon delivery.
5. Price and Payment
5.1 The price of the products (including VAT) will be as stated on our website or as confirmed in your order confirmation.
5.2 If the VAT rate changes between your order date and the date of delivery, we will adjust the VAT rate accordingly.
5.3 If we discover a pricing error:
5.3.1 If the correct price is lower than the stated price, we will charge the lower amount.
5.3.2 If the correct price is higher than the stated price, we will contact you for instructions before processing your order.
5.3.3 If a pricing error is obvious and could reasonably have been recognized by you, we may cancel the contract, refund any payments made, and require the return of any products.
5.4 Payment can be made using major credit and debit cards. All payments need to be authorized by the relevant card issuer.
5.5 If you fail to make a payment by the due date, we may charge interest on the overdue amount at 2% per annum above the base lending rate of the Bank of England. Interest will accrue daily from the due date until payment is made in full.
6. Cancellation and Returns
6.1 You have the right to cancel your order within 14 days of receiving the products. To do so, notify us in writing and return the products.
6.2 We will bear the costs of returning the products, either by arranging collection or reimbursing postage costs. Contact customer service at info@saunadekor.com to arrange collection.
6.3 Products must be returned in their original condition and packaging. We reserve the right to refuse returns if products are damaged or used.
6.4 Upon receipt of the returned products, we will process your refund within 14 days. Refunds will be made to the original payment method.
7. Warranty and Guarantees
7.1 Some products come with a manufacturer’s warranty. Details of the warranty will be provided with the product.
7.2 If you exercise your warranty rights, you may be subject to a call-out fee as follows:
7.2.1 Within the first year: no charge. 7.2.2 Within the second year: £49.99 plus VAT per visit. 7.2.3 Within the third year: £99.99 plus VAT per visit.
7.3 Call-out fees include the first hour of time spent on-site. For products located outside mainland UK, the warranty will cover parts only, not labor.
8. Liability
8.1 We are liable for:
8.1.1 Death or personal injury caused by our negligence or that of our employees, agents, or subcontractors. 8.1.2 Fraud or fraudulent misrepresentation. 8.1.3 Breach of legal rights related to the products. 8.1.4 Defective products under the Consumer Protection Act 1987.
8.2 We are responsible only for foreseeable loss or damage caused by our failure to comply with these terms. Loss or damage is foreseeable if it is obvious or if both parties knew it might happen.
8.3 We are not liable for indirect or special losses, including loss of profit, business interruption, or loss of business opportunity.
8.4 We are not responsible for damage to your property caused by us while performing services unless it is due to our negligence.
9. Complaints and Disputes
9.1 We aim to resolve disputes quickly and efficiently. Contact us at info@saunadekor.com for complaints.
9.2 If unresolved, you may refer the dispute to an Alternative Dispute Resolution (ADR) provider, such as The Retail Ombudsman. More information can be found at www.theretailombudsman.org.uk.
9.3 You have the right to pursue legal action in a court of law if you are not satisfied with the ADR outcome.
10. Personal Information
10.1 We collect and use personal information to process orders, handle payments, and deal with after-sales matters. This is necessary for fulfilling our contract with you.
10.2 Your personal information will be used in accordance with our privacy policy, which you can access here.
11. Transfer of Rights
11.1 We may transfer our rights under the contract to another business. You will be notified if this occurs, and you can cancel any outstanding orders.
11.2 You may only transfer your rights or obligations under these terms with our written consent.
11.3 No third party has rights under this contract, except where we explicitly agree, including the transfer of any product guarantee.

12.1 These terms are governed by English law. You may bring legal proceedings in English courts or in Scottish/Northern Irish courts if applicable.

13.1 We are not liable for delays or failures caused by events beyond our reasonable control, including pandemics, government actions, natural disasters, and other external factors.
13.2 Specific provisions apply to the Covid-19 pandemic, including any government actions or restrictions arising from the pandemic.
